1. What PokeCard is
1.1. PokeCard is an independent online marketplace for collectible trading cards and related collector products. It allows registered users to list, buy, sell, make offers and participate in auctions. It also offers optional marketplace services such as listing promotion and PokeCard Pro.
1.2. POKEMARKET OÜ (“PokeCard”, “we”, “us”) operates the platform. Unless a listing expressly names POKEMARKET OÜ as the seller, PokeCard facilitates the sale and is not the seller of the card. The contract for the card is between the buyer and the seller identified in the listing and order details; a separate services contract exists between the user and PokeCard. We do not describe the payment flow as an escrow or deposit guarantee.
1.3. PokeCard is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Game Freak or Creatures. All trademarks belong to their owners.
1.4. These Terms govern the platform's services. Mandatory consumer rights and other statutory rights always prevail over conflicting provisions of these Terms.
2. Who may use the platform
2.1. Users must be at least 18 years old and legally able to enter contracts, and provide correct registration and contact details. An account is personal unless registered as a business account. Users must keep their credentials secure.
2.2. Sellers must truthfully identify whether they act as a private seller or trader/business. This status must be clearly displayed to buyers before purchase. An individual who regularly trades commercially may be a trader even without registering a company; merely selecting “private seller” does not change legal status.
2.3. Business sellers must provide the information required by law, including legal identity, registered address, business contact details and relevant registration/tax details. We may request verification and suspend selling until necessary checks are completed. We may also request tax reporting information where legally required.
2.4. We may restrict or suspend accounts for fraud, counterfeit listings, payment abuse, illegal content, material breaches or security risks. Users may request reasons and contest an account or content moderation decision via Support, subject to applicable law.
3. Listing requirements and authenticity
3.1. Sellers must own or have lawful authority to sell the item; show accurate card name, set, language, edition, condition, quantity, grading and any defects; use truthful photos; and disclose damage, alterations, resealing or other important information.
3.2. Counterfeit, stolen, intentionally misrepresented or otherwise unlawful goods are prohibited. A slab, grade or claimed authenticity must be accurately described; an unverified claim is not a platform guarantee. Sellers are responsible for accurate titles and images and for packaging cards securely.
3.3. A seller must not list an item that is unavailable or simultaneously sell it elsewhere after a buyer has committed to purchase. We may remove or correct misleading listings and freeze disputed transactions, while observing applicable rights.
3.4. Listing order may be influenced by relevance, filters, freshness and paid promotion. Promoted items must be visibly identified as such. Promotions do not mean PokeCard has verified authenticity or seller reliability.
4. Prices, orders and payment
4.1. Item prices are shown in EUR. The listing and checkout identify the seller, item price, applicable taxes if any, delivery price, platform/payment service charges and the complete amount payable before the buyer places a binding order. Any seller-side fees must likewise be shown before a seller accepts the relevant service or sale. We do not add hidden charges after a purchase is confirmed.
4.2. The buyer service fee for a standard marketplace purchase is calculated from the current checkout rate and shown separately before confirmation; standard marketplace seller commission is €0.00. Auction fees are 2.5% of the winning item price for each party, reduced to 2.0% for a Pro participant. Pro reduces the marketplace percentage buyer fee by 0.5 percentage points, with a minimum of zero; fixed charges and delivery are unchanged. Promotion costs 1% of the listing price plus €0.49 for 24 hours. These amounts are simulated during sandbox testing. The checkout quotation is the applicable offer; no real-money marketplace tariff is announced by these test prices.
4.3. Payment options presented at checkout are processed using Montonio and/or the payment institutions or banks specifically identified in the checkout. Available methods can vary by country and transaction. We do not store full bank-card credentials. Payment is due when the buyer confirms the payment obligation.
4.4. A successful payment initiates the order workflow. An order may be cancelled and paid amounts returned where payment verification fails, the item is unavailable, fraud is suspected or the law otherwise requires it. The order record is available in the buyer and seller dashboards. Contact support for a copy. Sandbox confirmations do not evidence a real payment.
4.5. Buyers and sellers must not divert a PokeCard-originated transaction off-platform to avoid applicable fees or protections.
5. Offers, auctions and reservations
5.1. Sellers may accept, reject or counter offers. An accepted offer creates the right or obligation to complete the purchase under the terms presented to the parties, subject to checkout and applicable consumer law.
5.2. Sellers may offer auctions with durations shown in the auction interface (currently 24, 48 or 72 hours). A qualifying bid near the end can extend the closing time under the displayed anti-sniping rule (currently bids within the final 2 minutes). The current highest bid and total fees must be visible before bidding. Auction bids must be genuine. The winner is required to complete payment, subject to mandatory rights and platform dispute safeguards.
5.3. Auctions currently use sandbox balance with no real-money value. Bids reserve the amount and applicable charges; outbid holds are released and winning bids settle from the reserved test balance. Sandbox deposits and withdrawals are simulations. Do not deposit real money or send physical cards for test orders.
5.4. Online-only auctions do not automatically remove a consumer's statutory withdrawal rights when buying from a trader. Statutory exceptions apply only where legally established.
5.5. Cart reservations, where offered, are temporary (currently up to 15 minutes) and do not guarantee purchase after expiry or failed payment.
6. Shipping and order completion
6.1. Eligible delivery methods and destinations are those shown in the checkout. Integrated providers currently include Omniva, DPD and SmartPosti where enabled. International shipping availability depends on carrier coverage and live configuration. Finland and any other destination are available only when checkout returns a carrier and parcel machine for the selected route.
6.2. Current sandbox parcel charges are S €2.49, M €2.99 and XL €3.99 per seller checkout, based on the largest selected parcel size. Carrier availability is retrieved through Montonio; these are platform parcel rates, not a promise of a live carrier quotation. No real shipping is authorised for sandbox orders.
6.3. Sellers must package items suitably, obtain and use the required label, and hand packages over to the selected carrier within the dispatch timeframe displayed in the order. Tracking and verified carrier scans can update order status automatically. A created label alone is not proof of dispatch or delivery.
6.4. Shipment loss, damage, returns and non-delivery should be reported through the relevant order's Support / Report a problem function. Rights against the seller, carrier and platform depend on the facts and applicable law. See the Shipping Policy and Returns & Refunds Policy.
7. Seller payouts and disputes
7.1. Current payouts are simulated: buyer confirmation or expiry of the order’s review window after a recorded delivery event can release the seller’s test balance, unless a dispute or other hold applies. The review deadline is shown with the order; the default is 48 hours and is configurable. A balance-withdrawal request does not send a real bank transfer. There is no regulated escrow or deposit guarantee.
7.2. We may temporarily pause a seller payout while a reported loss, counterfeit allegation, damage, chargeback, withdrawal or other genuine dispute is investigated. We notify parties about the requested evidence and resolution where appropriate. Platform dispute procedures do not remove access to courts or mandatory consumer remedies.
7.3. Sellers must provide correct, own-account payout details and comply with identity verification, tax and anti-fraud checks. Payments and payouts may be delayed by provider processing times, banking days and legal requirements.
8. Cancellation, withdrawal, returns and complaints
8.1. Purchases from business sellers: where a consumer buys at a distance from a trader, they generally have a statutory right to withdraw within 14 days after receiving goods without giving a reason, unless a genuine legal exception applies. Consumers retain applicable rights for defective, misdescribed or counterfeit goods, including statutory conformity remedies. The seller is responsible under the sales contract; PokeCard provides the support and dispute interface.
8.2. Purchases from private sellers: the EU consumer 14-day change-of-mind withdrawal regime and the statutory trader-to-consumer guarantee do not generally apply. Buyers still retain rights under applicable contract law and can raise non-delivery, damage or material misdescription through PokeCard's dispute tools. PokeCard must identify sellers' business/private status before checkout.
8.3. Purchases directly from POKEMARKET OÜ: if PokeCard itself is identified as the actual seller, PokeCard bears the seller's legal consumer obligations for that purchase.
8.4. Unboxing a collectible, opening a sealed booster or removing a collector wrapper does not by itself extinguish a statutory withdrawal right. If handling exceeds what would be possible in a physical shop, the trader may be entitled to a lawful deduction for proven loss of value. Misdescribed or defective goods are dealt with separately. Refer to the detailed Returns & Refunds Policy, including the model withdrawal form.
8.5. Users may submit a complaint via their order's support ticket, the site's Contact page or support@mypokecard.eu. For complaints against PokeCard as the relevant trader, PokeCard will acknowledge and respond in writing within the timeframe required by Estonian law (normally 15 days), or explain any lawful delay.
9. Optional services: Pro and promotion
9.1. PokeCard Pro is currently a one-month, non-renewing paid marketplace feature. There is no automatic monthly renewal unless the user later expressly signs up to a separately disclosed recurring plan. The exact benefits, price, activation date and expiry date are displayed before purchase.
9.2. Listing promotion is an optional, separately priced service (currently a 24-hour promotion where offered). Promotion does not guarantee views, sales, placement or value appreciation. Promotions cannot continue after the related listing is sold or withdrawn.
9.3. When a consumer buys a PokeCard service online, applicable service withdrawal rules apply. If the consumer expressly asks for immediate performance within the withdrawal period, a proportionate amount may be payable for services actually supplied where the law allows. Any loss of withdrawal rights for fully performed services requires the legally required prior consent and acknowledgment; we do not impose a blanket non-refund rule.
10. Privacy, intellectual property and user content
10.1. PokeCard processes account, transaction, delivery, communication and technical data as explained in the Privacy Policy and Cookie Policy. Payment and delivery partners may act as independent controllers for their own regulated services.
10.2. Users grant PokeCard a non-exclusive licence to display and process their listing materials for operating and promoting the marketplace, while retaining their own rights. Sellers warrant they have the necessary rights to their photos and descriptions. Nothing permits users to infringe third-party trademarks or copyrights.
10.3. Illegal listings, rights complaints and concerns about content or account decisions may be submitted through Support with relevant listing references and supporting evidence. We may remove content and inform the affected user where required.
11. Liability, changes and governing law
11.1. We use reasonable care to maintain the platform, but cannot guarantee uninterrupted service. We do not exclude or limit liability where prohibited by law, including for intentional wrongdoing, gross negligence or mandatory consumer rights.
11.2. Changes to these Terms will be dated and communicated as legally required. Material changes will not retroactively remove rights arising from completed purchases. The version presented when a transaction was concluded governs that transaction, subject to law.
11.3. These Terms are governed by Estonian law without depriving consumers of mandatory protection under the law of their EU/EEA country of habitual residence. Mandatory jurisdiction rules remain unaffected.
11.4. If a consumer dispute with POKEMARKET OÜ cannot be resolved directly, eligible consumers may contact the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) via https://ttja.ee. For a dispute about goods sold by a third-party business seller, the proper trader is that seller; the platform can assist with communication. The former EU ODR platform was discontinued in July 2025 and is not a current submission route.
